10. FEES AND RENEWALS

11. MEMBERSHIP FEES
On certain pages a membership fee might apply or be charged and unless you notify us within 30 days before the renewal date of your membership/ subscription that you would want to cancel or auto renew via email, and confirmation of receipt has been received, your subscription will automatically renew and you authorize us (without notice to you) to collect the then applicable membership fees, using any valid payment source we have on record for you.
12. FEE AND REFUND POLICY
Free trials of certain LEGALLYFIT products and services may be offered from time to time and only for a limited period. The terms and conditions of such free trials shall be contained in the offer, but the remainder of the terms and conditions of this agreement will still apply to the trial period.
No refund of any amount paid shall be granted under any of the following circumstances:
1) if you have completed any free trial period and commenced with any section of the program;
2) if any part of the program or subscription, for payment, has been downloaded;
3) if a deposit is payable it will be non-refundable due to administration charges and fees and any other non-refundable terms contained in on any pages of the website or affiliated pages. By subscribing to this website, making a once off payment, becoming a member or by submitting a “job card” or request, you agree to the fees charged on this website and acknowledge that you do not have any objections to this monetary value being paid upon demand. You take full responsibility to ensure that your payment will proceed on a successful basis and that your credit card will be updated on our system as soon as same should expire.
13. TERMINATION / CANCELLATION OPTIONS
LEGALLYFIT reserves the right to cancel the agreement, without any refund to the client, with the client if the client:
- refuses to act upon advice given by any advice givers on this site,
- if the client refuses to pay certain funds or expenses to LEGALLYFIT or its advice givers or associated parties.

19. DISPUTE RESOLUTION BY BINDING ARBITRATION: PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS.

In the unlikely event that our customer service department is unable to resolve a complaint you may have (or if LEGALLYFIT has not been able to resolve a dispute it has with you after attempting to do so informally), we each agree to resolve those disputes in courts of general jurisdiction based in Gauteng, South Africa. LEGALLYFIT will pay only reasonable party and party fees should you prevail. Party and own party costs will apply should LEGALLYFIT prevail. Any arbitration under this Agreement will take place on an individual basis; class arbitrations and class actions are not permitted.
References to "LEGALLYFIT", "you", and "us" include our respective subsidiaries, affiliates, agents, employees, predecessors in interest, successors, and assigns, as well as all authorized or unauthorized users or beneficiaries of services or devices under this or prior agreements between us. Notwithstanding the foregoing, either party may bring an individual action in small claims court.
A party who intends to seek arbitration must first send to the other, by certified mail, a written Notice ("Notice"). The Notice to LEGALLYFIT should be addressed to PO Box 39953, Moreleta Park, Pretoria, Gauteng, 0044, South Africa ("Notice Address") and [email protected]. The Notice must (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought ("Demand"). If LEGALLYFIT and you do not reach an agreement to resolve the claim within sixty (60) calendar days after the Notice is received, you or LEGALLYFIT may commence arbitration/ court proceedings. During the arbitration, the amount of any settlement offer made by LEGALLYFIT or you shall not be disclosed to the arbitrator until after the arbitrator determines the amount, if any, to which you or LEGALLYFIT is entitled.
20. BREACHES OF THESE TERMS AND CONDITIONS
Without prejudice to LEGALLYFIT other rights under these terms and conditions, if you breach these terms and conditions in any way, LEGALLYFIT may take such action as LEGALLYFIT deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you. LEGALLYFIT undertakes to send you written notice to your last known e-mail address in the form of a warning and giving you 7 calendar days to rectify the position before proceeding in the above manner.
21. TERMINATION/ACCESS RESTRICTION
LEGALLYFIT reserves the right, in its sole discretion, to terminate your access and/ or disable your user ID and password to the LEGALLYFIT.co.za/ LEGALLYFIT.com website and the related services or any portion thereof at any time, without notice or explanation at LEGALLYFIT’s discretion.
If LEGALLYFIT provides you with a user ID and password to enable you to access restricted areas of this website or other content or services, you must ensure that the user ID and password are kept confidential.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and LEGALLYFIT as a result of this agreement or use of the LEGALLYFIT.co.za/ LEGALLYFIT.com website. LEGALLYFIT's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of LEGALLYFIT's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the LEGALLYFIT.co.za website or information provided to or gathered by LEGALLYFIT with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
22.2. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and LEGALLYFIT with respect to the LEGALLYFIT.co.za/ LEGALLYFIT.com website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and LEGALLYFIT with respect to the LEGALLYFIT.co.za/ LEGALLYFIT.com website. You may not assign or otherwise transfer the Terms and Conditions, or any right granted hereunder, without LEGALLYFIT's written consent. LEGALLYFIT's rights under the Terms and Conditions are freely transferable by LEGALLYFIT. Any rights not expressly granted herein are reserved.

LEGALLYFIT may provide you with notices, including those regarding changes to the Terms and Conditions (but it’s not compulsory to do), by email, regular mail, postings on the LEGALLYFIT.co.za/ LEGALLYFIT.com website, or other reasonable means now known or hereafter developed. LEGALLYFIT may suspend the website at anytime after a program has been completed. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this agreement and all related documents have been drawn up in English. The version last compiled by LEGALLYFIT will be the latest terms and conditions.
22.4. The suggestions provided in any of the meal guides are intended for general consumption and as information only. It is not individualized recommendations. It is also not provided to serve any medical purpose or be interpreted as advice. No information contained on this platform should supersede your medical practitioners’ direction. The recommendations made in the meal plan(s) has not been validated by any South African Food Board and is merely a suggestion to follow for optimal results. They are not intended to diagnose, treat, cure or prevent any condition or disease. This site is aimed at healthier eating habits and to educate individuals on how to live a better life in general.
